Boat Passenger and Snorkeling Waiver

I wish to participate as a passenger on the recreational chartered shoreline boat ride being operated by Top Cat Cruises Inc. (the “Boat Ride”) and I acknowledge that my participation in the Boat Ride is completely voluntary. I understand that there are inherent risks involved with boating/cruising which may include but not limited to, equipment failure or malfunction, boarding or disembarking of the vessel, entering and exiting the water/ocean, acts of fellow participants, perils of the sea and harm caused by other vessels. In that, I fully assume responsibility for my own safety, (including and without limitation, following all directions of the boat’s captain and crew) while participating in the boat ride. I also verify that I am physically able to participate. I release Top Cat Cruises Inc, and its owners, employees and associated personnel, to hold these entities harmless from any and all liabilities arising as a consequence of the above listed, or any other acts or omissions on their part, including but not limited to negligence of any type. I have carefully read this contract/waiver in its entirety and fully understand its contents and agree to the terms and conditions. I have not been cohered or forced to sign this document and do so of my own free will.
